We have created this privacy policy for people visiting the website https://daktyli.pl (hereinafter referred to as the " Website "), i.e. the online store Daktyli.pl - Najlepsze Świeże Daktyle (hereinafter referred to as the " Store ").

The controller of your personal data in connection with the use of the Store is: M BRANDS sp. z oo with its registered office at: UL. SZCZĘSNA 26, 02-454 Warsaw, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0001042298, NIP: 5223261527.

    • In the Store, we enable subscription to our newsletter. In connection with this, cookies are used to embed a subscription form on our Website and measure the effectiveness of subscriptions in this form. Modern e-mail marketing systems allow us to combine analytical data from mailing campaigns with analytical data from the Store. We can use this data to optimize the content of messages sent to newsletter subscribers.

  5. Social Media Plugins and Links
    • On our Website, we have placed links to our profiles in social media: Facebook / Instagram / LinkedIn / Twitter. If you visit our profile on a given service, the owner of that service will receive - just like in the case of users going from any other website to another website - information that you have reached these services from our Store.

    • In the Store, we use social plugins that allow, for example, sharing a product from our Store on your profile / liking our product on Facebook, saving graphics from our Website on your Pinterest account. Using such plugins involves transferring information from cookies to the owners of these social media sites:
      • the service provider will receive information that your browser has displayed our Website, even if you are not logged in to the given social networking site or do not have a profile there;
      • If you logged in to one of the above-mentioned social networking sites before visiting our Store, its owner will be able to directly assign your visit to our Website to your profile on that site.
    • If you do not want social media sites to assign data collected during your visit to the Store to your social media site, log out of those sites before visiting our Site. You can also completely prevent social plugins from loading on our Website by selecting the appropriate settings in the cookie consent management panel.
  6. Movies
    • Some videos on the Website are embedded using plugins from YouTube (owned by Google) / plugins from Instagram (owned by Meta Platforms) / plugins from TikTok. When you play such a video on our Website, Google / Instagram / TikTok receives information about this from your browser, even if you do not have a Google / YouTube profile / even if you do not have an Instagram profile / even if you do not have a TikTok profile or are not currently logged in. If you have previously logged in to the aforementioned service, this service provider will be able to directly assign the video playback to your profile.
    • If you want to prevent Google / Instagram / TikTok from collecting information about your activity on our Site, you can:

The legal basis for the use of necessary cookies by the Store (indicated above in the section "What cookies do we use?") is our legitimate interest, i.e. the right to run a Website supporting our business, and the need to maintain its security.
The legal basis for our use of other cookies is your consent.

In connection with our processing of your personal data using cookies, you have the rights described below at any time .

Our use of cookies, especially for advertising purposes, may involve so-called profiling. This means that we or the marketing companies whose services we use can create a user profile based on the information collected (e.g. e-mail address, order history, type of device, technology used, frequency of visits) and, on this basis, formulate purchase forecasts for the future. This allows us to make decisions about what content (including advertisements) to display on our and other websites.

# How long do cookies stay on the user's device?

It depends on whether they are "persistent" or "session" cookies. Session cookies, which are information necessary for browser functionalities to function correctly, expire at the end of the user session, i.e. each time you close our Site. Persistent cookies that make using the site easier (e.g. remembering the selected resolution, content layout, user preferences, recently viewed products) will be stored by the browser for longer and will remain there until the expiry date, unless you delete them yourself using the browser menu settings.

Providing the above data by you is not obligatory, but it is necessary to fulfil your order, issue an invoice to you, notify you about the status of your order, respond to your inquiry or complaint, etc.

# How long do we process data?

We process your data related to placing an order in the Store for as long as it is necessary to complete the order, as well as in accordance with accounting and tax regulations.

In addition, we will process the data for the time necessary to achieve the purposes listed above in the table (i.e. until our legal interest in enabling us to process ceases, or until you object to the processing, or until you withdraw your marketing consent - if you have given us one). Further processing will only be possible if we have such a legal obligation as the controller (in particular tax purposes) and possibly for archival purposes to protect ourselves against potential claims (until such claims become time-barred).

# Who do we share your data with?

In our business, we use the services of other cooperating companies, therefore your data may be entrusted by us to: the company providing us with software to run the Store, the accounting company, the hosting provider of our Website, the hosting provider of our e-mail, other companies whose services and marketing tools we use. Your data is also transferred to courier companies and possible payment intermediaries in order to fulfill your order, and these companies are separate administrators of personal data.

For the purposes of marketing activities described above in the "Cookies" section, we use services provided by entities based in the USA (Google, Facebook). In connection with the above, personal data may be transferred to third countries that are not members of the European Union. We are committed to respecting the confidentiality of your personal data and to guaranteeing you the possibility of exercising your rights. You can exercise your rights at no cost by sending us an e-mail or contacting us in another way.

Remember that in connection with the processing of your data you have the right to:

  • request from us access to the data we hold about you;
  • rectify your data;
  • to delete your data if it is no longer necessary for the purposes for which it was processed, or we have no other legal basis for processing it;
  • withdraw your consent to the processing of your personal data, if you have given such consent;
  • object to the processing of your data if we process it based on a legitimate interest;
  • restrictions on data processing;
  • lodge a complaint with the President of the Personal Data Protection Office if you believe that your data is being processed by us unlawfully.

# Additional information for newsletter subscribers

If you have subscribed to our newsletter, we will send you marketing information about our products and/or services, e.g. about new products, promotions or special offers.

You can unsubscribe at any time by clicking the link in each newsletter or by simply writing us a message.

A modern email marketing system allows us to analyze the actions of recipients, i.e. it gives us information whether a given message has been opened by you. We analyze such information to better adapt the content of the newsletter and notifications to your interests and send you personalized messages (profiling). You can object to such processing of your data by us at any time. In the event of a subscriber's inactivity for 18 months, we may stop sending them the newsletter. In such a case, we will remove you from the list of our subscribers (with additional notice).

We do not use your data to make decisions based on automated data processing that could affect your legal situation or have other similarly significant consequences for you.

- LIST OF ADVERTISING AND ANALYTICAL TOOLS USING COOKIES

  1. ANALYTICAL COOKIES:
    1. We use Google Analytics
      • The information that Google Analytics collects about users includes: how many times a user visits the site; which subpages the user visits; the date of the first and last visit; the duration of the visit; the page from which the user came to the site (the source of the visit); the browser the user uses; the link that was clicked; the location in the world from which the user is accessing, the anonymized (shortened) IP address, etc.
      • Google assigns its own identifier (so-called Google ID) to individual users and collects data obtained from cookies from various websites on its servers. We – as the owner of the Website – can receive reports (statistics) from Google exclusively related to traffic on our Website. These reports of course only include people who have consented to Google Analytics recording their visits on our Website.

    2. We use the Hotjar tool
      • This tool records data on the behavior of users on the Website, such as: the way the user navigates the page, scrolling, cursor movement, approximate location, device used, operating system, browser type. The data obtained in this way is processed in an aggregated and anonymized way - in order for us to improve the way our Website works.

    3. Cookies of our Store's software provider
      • The software provider, thanks to which our Store operates - i.e. the owner of the shoper.pl platform - places cookies on our Website in order to collect aggregate information about how customers use online stores (subpages opened and time spent on them, products displayed, clicks on the Store website, analytical information about purchases, e.g. conversion rates).
      • This data is used to create aggregate reports for e-shop owners, containing general (without personal data) information, including what products interest customers of a given shop, at what time of year there is increased traffic or sales in shops, etc. Thanks to this, sellers (including us) can improve their shops and optimize sales processes.

  2. ADVERTISING COOKIES
    1. We use Google Ads and other Google advertising tools
      • Google collects data on its servers obtained from cookies placed on your device. This data is collected on all websites on which you have allowed Google to use cookies for advertising purposes (including our Website), as well as from advertisements you have clicked on. Google uses this information to display advertisements on other websites you visit. Cookies from Google typically expire after 3 months.
      • We, as advertisers using Google services, do not have access to data from cookies saved on your device, but we can order advertisements to groups of recipients with characteristics selected by us, e.g. to all people who visited our website (or its specific subpage) in the last 7 days. This data is only statistical material for us, and we order advertisements only based on aggregate criteria (to specific target groups, not to a specific user).
      • We may also use (as part of our use of Google Marketing Platform) tools to measure the effectiveness of advertising campaigns (e.g. how many people clicked on a given advertisement within a given period of time).

    2. Meta Conversion Pixel (Facebook and Instagram)
      • We use the so-called "conversion pixel" (remarketing pixel) Meta to manage advertising on Facebook and Instagram.
      • If you agree to the use of this cookie on our Website, then using this tool, Meta Platforms services obtain information that you have visited our Website. This information is assigned to your profile on the given service, if you have one. If you are not a user of these services, then the information is assigned to the so-called "Facebook ID" created for you.
      • This allows us to commission advertisements on Facebook and Instagram to those who have already visited our Website or individual subpages (remarketing). We then only receive statistical data from Meta Platforms regarding the effectiveness of the advertisements (e.g. how many people saw our advertisement, how many people clicked on it), without reference to specific users.

    3. Email Marketing
      • For newsletter purposes, we use a tool provided to us by an external company.
